Operational Rules for the Microsoft® Dynamics™ Globe Trotter ERP License Challenge
1. OBJECT
Microsoft Europe – located at 39, Quai du Président Roosevelt, 92137 Issy Les Moulineaux, France and described hereafter as the ‘Organizing Company’ proposes on its site - http://ms-dynamics.e-nettarget.com/ as of the 1st December 2009 to 27th May 2010, a Promotional Operation entitled the ‘Globe Trotter - CEE ERP License Challenge’ based on selected Microsoft License Sales.
The product licenses concerned and the allotted points linked to the Promotional Operation’s agreements are:

2. PARTICIPATION
This Promotional Operation is open to Microsoft Dynamics Partners in the Central and Eastern Europe region.
2.1 Participation Conditions
Participation in the Promotional Operation is reserved solely for Microsoft Dynamics Partners based in Bulgaria, Czech Republic, Greece, Hungary, Poland, Romania, Russia, Ukraine, Latvia, Lithuania, Estonia, Slovenia, Serbia, Croatia, Slovakia, Cyprus and Malta.
2.2. Exclusions
Participants not complying with the conditions referred to below are excluded from the Promotional Operation: (i) physical persons in general cannot participate, e.g. social partners; associates and employees within the organizing company or within the participating Microsoft Dynamics Partner’s entity; (ii) any company which is controlling the participating Microsoft Dynamics Partner’s entity, and/or any company is controlled by the participating Microsoft Dynamics Partner’s entity (or is under common control with it), unless such controlling or controlled company is a Microsoft Dynamics Partner as well; (iii) in particular, the company hosting the Promotional Operation’s web site, as well as close family members of anyone who falls into any of the above categories (i.e.: partners, parents, brothers, sisters, children...); (iv) anyone who has collaborated in the organization of the Promotional Operation as well as their employees (and family members –see above).
2.3. Participation Supports
Participation in the ‘Globe Trotter - CEE ERP License Challenge’ is carried out by electronic means, on the dedicated web site, by means of a registration form. Access to the site is gained via any hardware connected to the Internet network. Registration by email is possible by sending the request at the following address http://ms-dynamics.e-nettarget.com/. Any other type of registration – particularly (presumed) oral registration (by telephone), by post or registration by fax, will not be considered valid.
2.4. Registration
To take part in the Promotional Operation, Microsoft Dynamics Partners must register their participation by connecting to the site http://ms-dynamics.e-nettarget.com/ or by emailing their details to v-kapiet@microsoft.com . Participants must have correctly completed and submitted their participation registration form with all necessary details. Each participant commits himself to completing all fields of the registration form with exact information. Organizing Company cannot accept any responsibility for entries not received due to lost, failed, delayed or interrupted connections or miscommunications, or other electronic malfunctions, or due to lost, late, mutilated, illegible, incomplete entries. Proof of posting/mail dispatch is not proof of receipt.
2.5. Identification
Each participant will supplement his participation registration according to procedures. The site will include technology that will make it possible for participants to identify errors in acquired data - and then correct it.
2.6. Veracity of communicated information
At all times the participant is responsible for the nature of information that is communicated, and for the modifications that could arise in the event of changes or removal (participants will be asked to re-communicate their co-ordinates in such cases).
2.7. Participant’s Responsibility
The participant assumes full and entire responsibility for the maintenance of confidentiality regarding their ‘Identifier’ and ‘Password’. Each participant is legally responsible for their participation account (including cases where the account has been accessed by a third party).
The Organizing Company cannot be held responsible for fraudulent use of the account. In ‘the ‘Globe Trotter - CEE ERP License Challenge’ no case is a participant authorized to yield his account or right of access to same to a third party. The ‘Globe Trotter - CEE ERP License Challenge’ is applicable to residents of all European countries of which are authorized to play. Participation in the ‘Globe Trotter - CEE ERP License Challenge’ implies the general acceptance of the rules in their entirety, and the ethical rules in force regarding the Internet.
2.8. Principle of the Promotional Operation and list of related prizes
During the Promotional Operation period, the totality of Microsoft Dynamics NAV and AX licenses concerned with the Promotional Operation, will be collected and communicated by local Partner Account Managers every 30 days to the Organizing Company. The agreements figures will be assessed at the beginning of the month of registration, and collected until the end of the Promotional Operation period. Registration is possible during the entire Promotional Operation period.
For New Customers we will count new licenses as per system and based on customer adds; for Existing Customers we will measure everything as Total revenue; multiple orders from the same Partner company will be counted once and on the total period (new user, new modules, migrations) for AX and NAV Business Essential and AX and NAV Advance Management without threshold limits.
Per each agreement signed with new customer organizations, the participant will accumulate points. For the amount of points per agreement, see grid at 1. At the end of the Promotional Operation period the accumulated points are added up. Winners are the participants that have collected the most points in their respective countries.
At the end of the Promotional Operation period, the participants who have achieved the best score in their country will win the following prize: 3 free Ticket to a World Wide Microsoft Event taking place in July, 2010 plus Training and marketing funding that will be distributed to the 3 Best Regional Partners (one Microsoft Dynamics Partner company per participating Country), as follows:
1st Partner will win 6,000 USD;
2nd Partner will win 4,000 USD;
3rd Partner will win 2,000 USD
In case Microsoft Dynamics Partners have achieved the same score, the selection criteria will be based on Customer Add growth year over year.
We will cover Event Ticket ONLY while flights and accommodation are at Partners’ expenses.
Agreements need to be closed, signed and processed by EOC by May the 27th, 2010 at 17.00, GMT.
All prizes will be offered solely to the participating Microsoft Dynamics Partner’s entity and not to their employees. It is up to the winning Microsoft Dynamics Partner’s entity to distribute any prize internally and at its sole discretion.
We will reward one Partner company per Country (Top 3 Countries).
2.9. Confirmation and validation of participation
To validate participation in the ‘Globe Trotter - CEE ERP License Challenge’ the participating sellers must correctly complete the registration from on-line. Each participant will be contacted by the Organizing Company, generally within 5 days of receipt of the form, through an electronic message which will confirm (or not) their participation in the Promotional Operation.
2.10. Promotional Operation Deadline
The Promotional Operation closing date is May the 27th, 2010 at 17.00, GMT. Any agreement carried out after 17.00, GMT, on the 27th May 2010 will not be taken into account for the ‘Globe Trotter - CEE ERP License Challenge’.
3. WINNERS ENGAGEMENT
On acceptance of a prize, the winning resellers expressly authorize the Organizing Company to use its name, its address etc., within the framework of any promotional activity and on any support platform (e.g.: on the Promotional Operation’s web site, in the Central and Eastern Europe region and abroad, for a 24-month period, without the participant being eligible for rights other than the prize won.
4. PRIZES
See condition 2.8. : 3 free Ticket to WPC taking place in Washington on July 12th -15th 2010 and Training and marketing funding that will be distributed as follows:
1st Partner will win 6,000 USD;
2nd Partner will win 4,000 USD;
3rd Partner will win 2,000 USD.
Funding and free tickets for WPC will be transferred to the winners through Microsoft local subsidiaries.
We will award the Best Regional Partners for the highest license sales to Existing Customer and to New Customer with a plaquette and bottle of champagne.
These awards will be shipped directly to the winning Partners from the organizing company.
5.
Participants agree that the Organizing Company, its parent or subsidiaries advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever, and will be held harmless by winner for any injuries, losses or costs or damage of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of a prize or parts thereof, or from participation in this Promotional Operation.

The Organizing Company reserves the right to modify these terms and conditions and to suspend or terminate/cancel the Promotional Operation at any time and for any reason, without any liability whatsoever. The organizing company makes no commitment to update information contained herein. It is a condition of entry that the rules are accepted as final, and that the participants agree to abide by the rules.
7.
The judge is the Organizing Company and its decision will be final and legally binding. Final prizes are to be defined on Microsoft’s sole discretion. The Organizing Company will not enter into correspondence on any matter to do with the Promotional Operation.
8.
Should tax liability arise, then it will be the responsibility of the winners to notify their own Government's relevant tax department. The Organizing Company takes no responsibility or liability for taxation or for any other costs incurred in connection with the prizes received in this promotion.
9.
Participants are solely responsible for evaluating, if the participating in this operational promotion including the receiving of a prize will be compliant with respect to the participating entity’s internal policies. By participating in this operational promotion the participant confirms that its internal policies permit the participants’ receipt of a prize as determined by the rules of this operational promotion.
